Bah 4.3 : Rafizi Kantoi Isu NFC #TolakPR #Tolakfitnah

It would also interest readers to note that the Sale and Purchase Agreements (SPA) for the eight units signed between Salleh and KL Eco City Sdn Bhd were dated 15 December 2011 (see pics).

For those of us who have ever borrowed from a bank to finance the purchase of property, you and I would know that banks would not disburse a loan unless and until full documentation is in place. Banks would require among others, an original copy of the Sale and Purchase Agreement of the property purchase. The SPA in this instance was dated 15 December 2011. Thus, Rafizi's claims that Salleh had defaulted on loans as far back as March 2011 is false and a big fat lie. Whichever way one looks, there would never or ever be eight loans dispensed by PBB for the KL Eco City office properties before 15 December 2011.

SUCH WAS THE EXTENT OF LIES, DISTORTIONS AND MISREPRESENTATIONS DISHED OUT BY RAFIZI RAMLI

If this is what a trained accountant does, Rafizi's accounting credibility is questionable. The MIA By-Laws state among others,

"A professional accountant in public practice shall not knowingly engage in any business, occupation or activity that impairs or might impair integrity, objectivity or the good reputation of the profession and as a result would be incompatible with the fundamental principles."

We thought that to spice it up a little, we are combining two (2) episodes in this article which are 1) Rafizi's wild and wanton allegation and 2) First Hard Evidence (Letter from Public Bank). Enjoy~

RAFIZI'S WILD AND WANTON LIES

In thirteen minutes, a web of lies, distortions and misrepresentations were weaved by Rafizi in wild abandon.

First, Rafizi said that eight loans had been taken to finance the purchase of the eight office properties which had a forced sale value of RM9,688,866.

Second,Rafizi said that Salleh had leveraged the borrowings on a government deposit placed at the bank.

Third,Rafizi said the government deposit was at peril because Salleh had defaulted on the eight loans for a year from March 2011.

Fourth, Rafizi claimed Salleh was not credit worthy as all Salleh had in his personal bank account was a mere RM421.

Fifth,Rafizi said with Salleh having just that paltry sum, the government deposit used as leverage, was believed in jeopardy. He alluded Salleh would likely default on the loans.

Sixth, Rafizi claimed Salleh was not financially sound to have qualified for the eight loans for the KL Eco City properties and therefore, the leveraging.

FIRST HARD EVIDENCE

Today KL Chronicle further debunks Rafizi's claims. First, a Public Bank Berhad correspondence dated 4 Januar y2012 (see pic) that confirms no loans had been taken from the bank

In this letter, readers will note the following (please see the writer's side comments typed in blue):

i. Public Bank Berhad (PBB) had on 23 May 2011, offered loan facilities to Salleh to finance the KL Eco City office property purchase.
Note the date of letter of offer.

ii. It was an offer letter addressed to Salleh and not to NFCorp.
Note NFCorp was not involved.

iii. As the personal loan offer was never taken up by Salleh for more than seven months, PBB cancelled their offer on 4 January 2012.
This letter therefore confirms no loans had been taken by Salleh from PBB to finance the KL Eco City office property purchase.

iv. Rafizi brazenly lied that Salleh had taken eight loans for the eight KL Eco City properties.
Since the PBB loan offer was cancelled on 4 January 2012, Rafizi's claim does not make for truth. No loans exist.

v. Rafizi lied when he said the loans were in default.
How could loan repayments enter into default when none were taken in the first place?

vi. Rafizi lied Salleh had defaulted on the eight loans from March 2011.
No loans exist to enter into default. Also note the PBB letter of offer was made on 23 May 2011. How could anyone default prior to the date of the offer letter? Rafizi claims Salleh defaulted from March 2011??

vii. Rafizi also lied that the government deposit of RM71 million was in jeopardy because of the default.
How could there be any jeopardy when no loans exist for the eight KL Eco City properties?

viii. Rafizi lied Salleh was not credit worthy to qualify for loans and that the eight loans given by the bank were suspect.
Again, how could anything be suspect when no loans exist nor were any taken?

Oh btw, Part 4 is not the final part of this sequel. Fortunately, we have more dirt to share with our readers of the lies, distortion and misrepresentation of @rafiziramli .. up till the 13th General Election In sya ALLAH...

There are five (5) Sections to this article. The sections are:

1. Introduction
2. Rafizi's wild and wanton allegation
3. First Hard Evidence (Letter from Public Bank)
4. Second Hard Evidence ( Sales and Purchase Agreement KL Eco City Project)
5. Questions running in our minds

Introduction

The alarm bells did ring loud at Rafizi's news conference of 7 March 2011. Rafizi shocked the media and riled audiences with revelations that the directors of National Feedlot Corporation (NFCorp) had acquired eight swanky office lots from the plush KL Eco City development in Bangsar. Brandishing full-coloured visuals and dishing out bank documents to the media, Rafizi said eight loans had been taken for eight office lots leveraged on a government deposit placed at the bank.

In documents that Rafizi obtained illegally from a Public Bank Berhad clerk, Rafizi led the media into believing that he had the hard facts on the loans as well as information on the poor credit standing of the directors to have qualified for these loans. Rafizi claimed that the loans were taken at the jeopardy of NFCorp's RM71 million government deposit placed in the bank when he provided a sly analysis of the bank documents he distributed.

For many, it was a very alarming news conference. The shocking revelation of falsehoods sent reverberations that resulted in NFCorp chairman Datuk Seri Dr Mohamad Salleh Ismail being charged in the following days (a claim Rafizi proudly holds – see tweet below).
One must see the news conference given by Rafizi to get a true and accurate picture on what he had said and claimed. MalaysiaKini captured it all on camera and shares it here :

To fulfill our promise to our readers, we would continue by exposing more of the lies, distortion and misrepresentation of Rafizi Ramli later. However, below is a brief introduction to what we will be exposing...

In Islam, "fitnah" is deemed many times more serious than just a lie. "Fitnah, the act of lying to the extreme, is even described as worse than killing", reads the Surah Al- Baqarah Verse 191.

PKR Strategy Director Rafizi Ramli should perhaps review his stand and take cognizance of the retribution that will confront him. He had after all said among others, that he would be observing religious obligations when he announced the rationale behind his quitting a lucrative job as CEO to the Selangor Economic Advisor's Office in June 2012.

In the first three parts, KL Chronicle had debunked Rafizi's pack of lies, distortions and misrepresentations. Today, Part 4 exposes Rafizi's biggest blunder that has brought the law against him. Rafizi had at a news conference, dished out more than half a dozen lies, distortions and misrepresentations to deceive the media and public. In the process, Rafizi violated the Banking and Financial Institutions Act, 1989 (BAFIA).

He had deliberately exposed 21 bank accounts of National Feedlot Corporation and its group of companies as well as those of the directors, to weave a fabric of lies. Rafizi claimed that eight loans had been taken for eight KL Eco City office properties. He alarmed audiences and the authorities that the National Feedlot Corporation chairman had only RM421 in his personal bank account and painted doubtful circumstances.

Well today, KL Chronicle presents ROCK HARD EVIDENCE that no loans were ever taken in all the hype and melodrama by Rafizi Ramli. When we say HARD EVIDENCE it means letters, reference to news reports and interviews by Rafizi Ramli etc
